Fire-safety acceptance, circulation permits for equipment and periodic self-inspection are three different tasks carried out by three different parties. A facility in operation does the self-inspection itself and keeps the records.

2

The investor or building owner organizes acceptance, is responsible for the result and declares it in the PCCC database before the building is put into operation. Article 10 of Decree 105/2025/NĐ-CP (police inspection of acceptance work) was repealed from 15/09/2026. The corresponding rule in Law 55/2024/QH15 (Luật 55/2024, Luật Phòng cháy, chữa cháy và cứu nạn, cứu hộ số 55/2024/QH15) is not applied temporarily until 28/02/2027.

3

A facility that is already using equipment does not apply for a permit for each device. It must keep the equipment working, carry out self-inspection on a fixed cycle and record each periodic self-inspection on Form PC02.

Many facility owners lump “acceptance”, “equipment certification” and “fire-safety inspection” into one task and assume a single piece of paper settles everything. In fact these are three different tasks, carried out by three different parties, and all three changed in 2026. Understanding each one correctly helps the facility prepare the right dossier, with the right party, at the right time.

Quick answer:

  • Acceptance is organized by the investor or building owner after new construction or renovation, and the result is declared in the PCCC database before the building is put into operation. The police step of rechecking the acceptance work is not currently carried out.
  • Equipment certification and circulation permits are procedures before PCCC equipment is sold on the market. They are not a task for the facility that uses the equipment.
  • Regular and periodic self-inspection is carried out by the facility throughout its operation, with set intervals and standard record forms.

Who is responsible for fire-safety acceptance?

Fire-safety acceptance (PCCC) is the step of checking the work as built against the approved fire-safety design before the building is put into use. The Law on Fire Prevention and Fighting and Rescue and Relief No. 55/2024/QH15 (Luật 55/2024) assigns this task to the investor or building owner:

  • Organize construction and acceptance according to the approved fire-safety design (Clause 1, Article 18).
  • Accept the work in stages, by component, by system and as a whole; any concealed part must be accepted before the next construction stage begins (Clause 2, Article 18).
  • Bear legal responsibility for the acceptance result (Clause 3, Article 18).

Decree 105/2025/NĐ-CP (Decree 105), as amended by Decree 347/2026/NĐ-CP (Decree 347) from 15/09/2026, further specifies that the investor organizes acceptance, is responsible for the result, and declares it in the PCCC, rescue and relief and fire alarm transmission database before the building is put into operation (Point đ, Clause 1, Article 12 of Decree 105, amended by Article 16 of Decree 347).

Acceptance does not happen only once, at new construction. When renovation or a change of use alters fire-safety conditions, buildings subject to appraisal must revise the design and have it appraised again (Clause 2, Article 17 of Law 55/2024) before the changed part is built and accepted. Decree 105 lists specific cases, for example adding floors, reducing exit routes, or changing the main functional zoning inside the building (Clause 4, Article 6). So before adding a room, adding a floor or changing how a floor is used, ask your fire-safety consultant whether the change requires re-appraisal.

In 2026, how has the police check of acceptance work changed?

Law 55/2024 provides that the specialized management agency inspects the acceptance work after the investor accepts it (Clauses 4 and 5, Article 18). Two changes in 2026 affect the police part of this process:

DocumentContentTiming
Resolution 66.18/2026/NQ-CP (Appendix I.1)Does not carry out the fire-safety acceptance inspection under Point c, Clause 5, Article 18 of Law 55/2024 and Article 10 of Decree 105From 01/07/2026 to 28/02/2027
Decree 347/2026/NĐ-CP (Clause 1, Article 30)Repeals Article 10 of Decree 105 (police inspection of acceptance work)From 15/09/2026

Things that have not changed:

  • The investor still organizes acceptance, is responsible for the result and declares it in the PCCC database before the building is put into operation.
  • The head of the facility must still maintain fire-safety conditions throughout operation.
  • Inspection under construction law for each building (Point a, Clause 5, Article 18 of Law 55/2024) must be verified against the specific dossier at the time of the procedure.

Decree 347 itself refers to the amended Law on Fire Prevention and Fighting and Rescue and Relief, which is about to take effect (Clause 2, Article 41). The appropriate approach is to follow the legal documents in force when the dossier is prepared, and to update when the amended law is adopted.

Has equipment certification changed, and does a facility need a permit?

This is the second point that is often misunderstood. There are three milestones to know:

  1. Certification under the old method ends on 30/06/2026. Issuance of PCCC equipment certificates, and the management and use of inspection stamps, continue until 30/06/2026 (Clause 1, Article 46 of Decree 105).
  2. Circulation permits apply before equipment is placed on the market. Equipment listed in Appendix V of Decree 105 must obtain a circulation permit before it circulates on the market. Other equipment must comply with the rules on product and goods quality and labeling (Clause 1, Article 23 of Decree 105). The applicant is the producer, assembler or importer.
  3. Decree 347 sets a new direction but does not apply immediately. Article 21 of Decree 347 moves to declaring equipment information in the PCCC database, and Clause 3, Article 30 repeals Appendix V. These two parts take effect only together with the amended Law on Fire Prevention and Fighting and Rescue and Relief (Clause 2, Article 41 of Decree 347).

For a facility that already uses installed equipment, no procedure requires a permit for each device. What the facility needs to do is:

  • When buying new equipment: choose a supplier with quality documents and clear circulation papers, and keep the invoices and accompanying documents.
  • During use: maintain the equipment’s function (Point e, Clause 3, Article 8 of Law 55/2024), keep an equipment tracking log in the facility’s PCCC file (Point e, Clause 1, Article 4 of Decree 105), maintain the equipment according to technical guidance, and replace it when it is damaged.

How must a facility carry out regular and periodic self-inspection?

This is a task the facility carries out throughout its operation, even long after acceptance. Clauses 1 and 2, Article 14 of Decree 105 provide:

Type of self-inspectionIntervalRecording
RegularNo more than once a monthThe head of the facility decides the timing, scope and form of recording
Periodic (facilities in Appendix II)Once every 06 monthsMinutes on Form PC02
Periodic (other facilities in Appendix I)Once a yearMinutes on Form PC02

Under the same Clause 2, the facility sends its PCCC performance report on Form PC04 to the directly managing authority, or updates it in the PCCC database, before 15 June and before 15 December each year. Self-inspection minutes and this report must be kept for at least 05 years (Clause 4, Article 4 of Decree 105, amended by Article 11 of Decree 347).

When self-inspecting, an effective approach is to follow the matters that the authority will check during an inspection (Clause 1, Article 13 of Decree 105), including:

  • Equipping and maintaining the operation of PCCC equipment and systems, the electrical systems used for firefighting, and firefighting water sources.
  • Safety conditions when using sources of fire, heat and flammable materials.
  • Escape routes and emergency exits; measures to prevent fire spread, fire barriers and smoke control.
  • Prohibition, warning and instruction signs, and compliance with the facility’s PCCC rules.

Which agencies inspect a facility, and on what cycle?

Apart from self-inspection, the facility is also subject to periodic inspection by competent authorities (Article 13 of Decree 105; Points a and b, Clause 2, amended by Article 17 of Decree 347):

Inspecting agencySubjectsPeriodic cycle
Police agencies, as delegatedGroup 1 / Group 2 facilities in Appendix IIOnce every 01 year / 02 years
Specialized construction authority (assigned by the provincial People’s Committee)Group 1 / Group 2 facilities in Appendix IIOnce every 01 year / 02 years
Commune-level People’s CommitteeFacilities in Appendix I, except those in Appendix IIOnce every 03 years

At the end of each inspection, the inspection team draws up minutes on Form PC03 (Clauses 3 and 4, Article 14 of Decree 105). The head of the facility prepares the documents according to the content that has been notified (Clause 7, Article 14). A complete and up-to-date PCCC dossier makes the inspection go smoothly and clearly.

What risks come with getting it wrong?

Decree 106/2025/NĐ-CP sets administrative penalties in the field of PCCC and rescue and relief. It was amended by Decree 69/2026/NĐ-CP (effective 20/04/2026) and by Decree 347. For acceptance specifically, Article 32 of Decree 347 amends Clauses 3 and 4, Article 18 of Decree 106/2025 to penalize two acts:

  • Putting a building into operation or use when the investor or building owner has not completed the organization of acceptance for PCCC.
  • Putting a building that must be appraised into operation or use when there is no written appraisal of the fire-safety design.

The specific penalty for each act must be checked against the legal documents in force at the time of handling. More important than the penalty is actual safety: a fire alarm system that works well and clear escape routes help handle an incident from the start and protect the facility’s workers, customers and property.

How Thái Tín supports

Thái Tín is the coordinating contact. It receives facility information, reviews with the facility owner the PCCC papers already held, draws up a list of tasks by stage, and connects the facility with licensed consulting, design and PCCC construction partners to handle the technical part. Specifically:

  • Review the existing dossier (appraisal documents, acceptance minutes, as-built drawings, equipment tracking log, self-inspection minutes) to identify what is missing against the legal provisions in force.
  • Draw up a self-inspection schedule and reporting plan before 15/06 and 15/12, suited to the facility’s group.
  • Follow up progress with specialist partners within the agreed scope. Acceptance is organized by the investor, and inspection belongs to the competent authority.

Costs include the consulting partner’s service fee, construction fees (based on the actual work) and third-party fees where applicable. A quotation is given after the site has been viewed. To get started, send facility information (address, industry, floor area, existing PCCC papers) through the contact page, or see services by business lifecycle to get a list of tasks.

Questions and answers

If the police acceptance inspection no longer exists, does the investor still need to organize acceptance?

Yes. The investor or building owner still organizes fire-safety acceptance and is legally responsible for the result (Clauses 1 and 3, Article 18 of Law 55/2024/QH15), and declares it in the PCCC database before the building is put into operation (Point đ, Clause 1, Article 12 of Decree 105/2025/NĐ-CP, amended by Article 16 of Decree 347/2026/NĐ-CP). What has changed is the police step of checking the acceptance work: Article 10 of Decree 105/2025 was repealed from 15/09/2026 (Clause 1, Article 30 of Decree 347/2026). The corresponding rule in Point c, Clause 5, Article 18 of Law 55/2024 is temporarily not applied until 28/02/2027 (Resolution 66.18/2026/NQ-CP).

Do fire extinguishers and smoke detectors already installed need a new certification?

No procedure requires a facility to apply for a certificate for equipment it is already using. Certification of PCCC equipment was carried out only until 30/06/2026 (Clause 1, Article 46 of Decree 105/2025/NĐ-CP). A circulation permit is a procedure before equipment is placed on the market (Article 23 of Decree 105/2025). The facility must maintain the equipment's function (Point e, Clause 3, Article 8 of Law 55/2024/QH15) and keep an equipment tracking log in its PCCC file.

What is the difference between regular and periodic self-inspection?

Regular self-inspection: the head of the facility decides the timing, scope and form of recording, but not more than once a month (Clause 1, Article 14 of Decree 105/2025/NĐ-CP). Periodic self-inspection: once every 06 months for facilities in Appendix II, and once a year for other facilities in Appendix I. At the end of the inspection, minutes are drawn up on Form PC02 (Clause 2, Article 14).

What if a building is put into use before acceptance is complete?

It may be subject to administrative penalties. Clauses 3 and 4, Article 18 of Decree 106/2025/NĐ-CP, amended by Article 32 of Decree 347/2026/NĐ-CP from 15/09/2026, set penalties for putting a building into operation or use before acceptance for PCCC is completed, or before a written appraisal of the design is obtained for buildings that must be appraised. The specific penalty must be checked against the legal documents in force at the time of handling.

Who is responsible for preparing and keeping self-inspection minutes?

The head of the facility, meaning the legal representative of the facility or the person directly assigned to manage it (Clause 11, Article 2 of Law 55/2024/QH15), prepares, manages and updates the facility's PCCC dossier (Clause 2, Article 4 of Decree 105/2025/NĐ-CP). Self-inspection minutes on Form PC02 and the report on Form PC04 must be kept for at least 05 years (Clause 4, Article 4, amended by Article 11 of Decree 347/2026/NĐ-CP).
