A factory is the type of facility with the most fire prevention and fighting (PCCC) tasks, because it involves both design and construction, and daily operation with people, machinery and goods. The most common question is not “where do I apply for a fire safety certificate”, but: what stage is my factory at, and what needs to be completed at that stage.
Short conclusion: a factory’s fire safety work goes through three stages — design, construction and acceptance, operation. Each stage has its own tasks, responsible person and records. The rules are being adjusted in 2026, so they need to be re-checked at the time of preparing the dossier.
Which category does your factory fall into?
The 2024 Law on Fire Prevention and Fighting and Rescue (Law 55/2024/QH15) defines a “facility” as a house or work used for production, business, etc. on the list prescribed by the Government (clause 7, Article 2). The list is in the appendices of Decree No. 105/2025/NĐ-CP, as amended by Decree No. 347/2026/NĐ-CP from 15 September 2026.
| Appendix (Decree 105/2025) | Content | Meaning for a factory |
|---|---|---|
| Appendix I | Facilities subject to fire safety management | Must have fire safety records, self-inspect, report |
| Appendix II | Facilities with fire and explosion hazard | More frequent self-inspection; the managing authority inspects every 1–2 years |
| Appendix III (replaced by Decree 347/2026) | Works subject to fire safety design appraisal | Must have the design appraised before construction |
| Appendix VII | Facilities required to buy compulsory fire and explosion insurance | Must hold an insurance certificate |
The specific thresholds (area, volume, fire and explosion hazard class of goods) depend on each type of factory. The work’s records need to be compared against each appendix; if unclear, ask the local managing authority or a unit with fire safety consulting functions.
Stage 1: design and appraisal before building or renovating
- Construct only after having the appraisal document. A work subject to fire safety design appraisal may be constructed or renovated only after having the appraisal document of the competent authority (clause 3, Article 17 of Law 55/2024).
- Integration with construction procedures. For a work in Appendix III that must have its Feasibility Study Report appraised at the construction specialized agency, the fire safety design appraisal is integrated into that procedure (clause 1, Article 6 of Decree 105/2025, as amended by Article 12 of Decree 347/2026).
- Change of use. A renovation or change of use that alters fire safety conditions requires the design to be adjusted and re-appraised (clause 2, Article 17 of Law 55/2024). A common situation: leasing an old workshop used as a warehouse to convert it to production, or bringing in goods more flammable than before.
What to check before signing a factory lease: whether the factory already has an appraisal document, acceptance record and as-built drawings of the fire safety system; whether the intended business matches the appraised use.
Stage 2: construction, acceptance and declaration
Design, construction and installation of the fire safety system are carried out by units with the proper functions. After construction:
- The investor organizes fire safety acceptance, is legally responsible for the result and declares it on the PCCC Database system before putting the work into operation (point đ, clause 1, Article 12 of Decree 105/2025, as amended by Article 16 of Decree 347/2026).
- There is no longer a procedure of Police inspecting acceptance work under the decree. Article 10 of Decree 105/2025 was repealed from 15 September 2026 (clause 1, Article 30 of Decree No. 347/2026/NĐ-CP). The corresponding provision in point c, clause 5, Article 18 of Law 55/2024 is temporarily not implemented until the end of 28 February 2027 (Resolution No. 66.18/2026/NQ-CP).
- Inspection under construction law for each work needs to be verified at the time of preparing the dossier.
The draft law amending the Law on Fire Prevention and Fighting and Rescue is expected to be submitted to the National Assembly in October 2026 (Resolution No. 11/2026/UBTVQH16); follow it when the law is passed.
Stage 3: operation — the factory’s fire safety management records
Under clause 1, Article 4 of Decree 105/2025 (some points amended by Decree 347/2026), a facility’s fire safety records include these main groups:
- Facility information sheet (Form PC01) and fire safety and rescue rules.
- Appraisal document, acceptance record and as-built drawings of the fire safety system (for works within scope).
- Decision establishing the facility’s fire safety and rescue team or an assignment document, with training results.
- The facility’s fire fighting and rescue plan (Form PC06), built and approved by the head of the facility (clause 1, Article 15).
- fire safety equipment logbook; self-inspection record (Form PC02); fire safety work result report (Form PC04).
- Compulsory fire and explosion insurance certificate (if within scope).
- Inspection records and recommendation documents of the competent authority (if any).
The head of the facility prepares, manages and updates these records (clause 2, Article 4).
A factory’s fire safety calendar through the year
| Task | Frequency / deadline | Basis |
|---|---|---|
| Regular self-inspection | Interval between inspections of not more than 01 month | Clause 1, Article 14 of Decree 105/2025 |
| Periodic self-inspection, PC02 record | Every 06 months (Appendix II); every 01 year (other Appendix I facilities) | Clause 2, Article 14 of Decree 105/2025 |
| Send the PC04 report or update on the database system | Before 15 June and before 15 December each year | Clause 2, Article 14 of Decree 105/2025 |
| Fire fighting plan drill | At least 01 time per year | Clause 1, Article 16 of Decree 105/2025 |
| Professional training / refresher | Training every 05 years; refresher annually | Clause 4, Article 29 of Decree 105/2025 (clause 5 added by Article 22 of Decree 347/2026) |
| Equipping and connecting fire alarm signal transmission devices | By 1 July 2027 at the latest (Appendix I facilities) | Clause 2, Article 27 of Decree 105/2025 |
The managing authority inspects periodically every 01 year for group 1 facilities and every 02 years for group 2 facilities in Appendix II (points a and b, clause 2, Article 13 of Decree 105/2025, as amended by Article 17 of Decree 347/2026); the commune-level People’s Committee inspects periodically every 03 years for Appendix I facilities not in Appendix II (point c, clause 2, Article 13 of Decree 105/2025).
Points where factories often struggle and how to handle them
- A leased factory without original fire safety records. When it happens: the previous owner did not hand over, or the factory was built before the current rules. What to check: whether the appraisal/approval document and acceptance record exist. How to handle: ask the lessor to provide them; if missing, ask a unit with the proper function to survey the current condition to determine what must be added.
- Changing goods, changing warehouse layout. More flammable goods or a changed stacking height may change safety conditions. How to handle: review with a fire safety consulting unit before making the change, and determine whether the design must be adjusted.
- Records exist but are not updated. Self-inspection records and the equipment logbook left blank for many months. How to handle: assign one person in charge and set a fixed schedule following the table above.
- A facility operating before 1 July 2025. An Appendix I facility already managed under the old rules continues to be managed and inspected under Articles 13 and 14 of Decree 105/2025 (clause 6, Article 46, added by Decree 347/2026). Documents issued before 15 September 2026 that are still valid continue to be used until they expire (clause 3, Article 40 of Decree 347/2026).
How Thái Tín supports you
Thái Tín receives information on the factory, reviews with the investor or facility owner the documents already held, draws up a list of fire safety tasks by the correct stage and connects units with the proper functions for fire safety consulting, design and construction. Thái Tín coordinates and tracks progress within the agreed scope; appraisal and inspection belong to the competent authority, and acceptance is organized by the investor. Foreign-invested enterprises and factories with many workers are advised according to their own operating characteristics.
Costs include the service fees of the consulting and construction units (by actual volume) and third-party fees if any; a quote is given after the current condition is checked. See also services across the enterprise life cycle.
Prevention: keeping the factory always ready for inspection
- One fire safety records folder with all the groups above, including electronic copies.
- One person in charge tracking the self-inspection schedule, the 15 June – 15 December reports and training.
- A review whenever something changes: changing goods, expanding the factory, changing the layout.
- Link with the general management system: if the business is building a system under ISO 9001, the fire safety calendar can be put into the internal control plan.
If you need to know what your factory is missing, send the facility’s information (address, area, business line, fire safety documents already held) to get a list of tasks to do.
Questions and answers
If we lease a ready-built factory, who is responsible for fire safety?
The head of the facility — the legal representative or the person assigned to directly manage the facility (clause 11, Article 2 of Law 55/2024/QH15) — is responsible for fire safety within the scope of management. The lessee and the lessor should state clearly each party's fire safety tasks in the lease contract. If a change of use alters the fire safety conditions, the design must be adjusted and re-appraised (clause 2, Article 17 of Law 55/2024).
What should a factory that is built but not yet accepted for fire safety do in 2026?
The investor organizes fire safety acceptance, is responsible for the result and declares it on the fire prevention and fighting (PCCC) Database system before putting the work into operation (point đ, clause 1, Article 12 of Decree 105/2025, as amended by Decree 347/2026). The procedure of Police inspecting acceptance work under Article 10 of Decree 105/2025 was repealed from 15 September 2026 (clause 1, Article 30 of Decree No. 347/2026/NĐ-CP); the corresponding provision in point c, clause 5, Article 18 of Law 55/2024 is temporarily not implemented until the end of 28 February 2027 under Resolution No. 66.18/2026/NQ-CP, and the amended law needs to be followed. Inspection under construction law must be verified for each work.
Is fire and explosion insurance mandatory for a factory?
It is mandatory for facilities on the list required to buy compulsory fire and explosion insurance (clause 1, Article 48 of Law 55/2024/QH15; Appendix VII of Decree No. 105/2025/NĐ-CP). The factory's type and scale need to be checked against this list.
How often must a factory self-inspect fire safety?
Regular self-inspection with an interval between inspections of not more than 01 month; periodic self-inspection every 06 months for facilities in Appendix II and every 01 year for other facilities in Appendix I, with a record made on Form PC02 (clauses 1 and 2, Article 14 of Decree No. 105/2025/NĐ-CP).
How long does fire safety work for a factory take?
There is no common figure. The time depends on the condition of the work, the design records already held, the volume of construction and the handling authority. The first task is to check the status, and only then draw up a roadmap.
