A facility that produces or trades in food must hold a food safety eligibility certificate (Article 11, Decree 15/2018), except for the cases in Clause 1, Article 12:
- small-scale primary production; small-scale preliminary processing; no fixed location;
- small-scale food trading; trading in pre-packaged food; street food;
- tools, packaging materials and food containers;
- restaurants in hotels; collective kitchens not registered in a food business line;
- facilities that already hold valid GMP, HACCP, ISO 22000, IFS, BRC, FSSC 22000 or equivalent certification.
Facilities not required to obtain the certificate must still meet food safety conditions (Clause 2, Article 12). The certificate is valid for 03 years (Article 37, Law on Food Safety). In 2026, Decree 15/2018 continues to apply because Decree 46/2026 is suspended under Resolution 15/2026/NQ-CP.
